Memiliki rumah pada usia yang muda dikatakan sebagai satu tanda ukur kejayaan. Siapa tidak mahu memiliki rumah seawal itu kan? Setiap Usaha untuk mendapatkan sesuatu hartanah sentiasa datang bersama beberapa proses dan urusan dokumentasi yang kadang kala memerlukan khidmat mereka yang pakar dalam hal berkaitan undang-undang. Apabila berkait dengan undang-undang, semestinya yang mempunyai kepakaran ini ialah pihak peguam itu sendiri.<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Peguam bertanggungjawab untuk membantu menguruskan hal berkaitan pembelian atau penjualan rumah sehinggalah membantu pembeli atau penjual mempertahankan hak sekiranya berlaku sebarang masalah.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Dalam urusan jual beli hartanah, perkara paling penting adalah melantik peguam dan kebanyakan tuan rumah atau penjual dilihat tidak gemar menggunakan khidmat peguam untuk mewakili mereka dengan alasan utama menjimatkan kos.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Jual beli hartanah tidaklah semudah yang disangka dan bukan sekadar mengisi borang atau urusan surat-menyurat semata-mata kerana ia membabitkan kontrak perjanjian jual beli dan undang-undang yang termaktub dalam Kanun Tanah Negara 1965.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Dalam artikel kali ini , pihak RDC akan kongsikan tips untuk melantik dan berurusan dengan peguam hartanah . Presiden Persatuan Guaman Hartanah Malaysia (HartaGuam) Salkukhairi Abd Sukor berkata, terdapat beberapa langkah boleh diikuti untuk memilih peguam hartanah terbaik bagi mengelakkan daripada menjadi mangsa kepada peguam yang tidak bertanggungjawab.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Antara tips-tips yang dikongsikan oleh beliau dalam artikel beliau pada 4 oktober 2019 di laman facebook beliau :-<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">1. Apabila ada rakan-rakan atau kenalan yang merekemenkan seorang peguam kepada kita, dinasihatkan agar kita tidak mempercayai bulat-bulat peguam yang disyorkan . seeloknya, ambil sedikit masa, untuk mengenali peguam tersebut secara peribadi. Cubalah berhadapan dan berkenalan dengan peguam tersebut, jangan mengambil langkah mudah dengan hanya berurusan melalui wasap. Pandangan setiap orang amat lah berbeza, termasuk lah pandangan kita dan rakan.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">2. Elakkan memilih peguam yang mengendalikan terlalu banyak kes dalam satu-satu masa. Kerana amat dibimbangi, mereka tidak sempat memberi tumpuan atau focus terhadap kes kita. Semakin banyak kes, dibimbangi semakin besar peluang mereka ingin menyeleweng.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">3. Elakkan memilih peguam yang membuat bisnes sampingan yang terlalu banyak pada satu masa.Pendek kata bukan bisnes firma gauaman sahaja tetapi semua bisnes dia tapau termasuklah menjual budu.Dibimbangi jika mereka kehabisan modal dalam bisnes tertentu,duit, anak guam menjadi mangsa untuk mereka rolling untuk buat modal bisnes.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">4. Pastikan memilih peguam yang bertanggungjawab dan tidak menyerahkan semua urusan kes kepada stafnya.Dikhuatiri berlaku penyelewengan wang yang dilakukan oleh staf peguam tersebut<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">5. Peguam yang dikenali ramai amatlah disarankan . Dengan istilah \u201cpeguam Selebriti\u201d yang selalu muncul di media massa atau selalu muncul dimedia sosial berkongsi sesuatu yang baik dan bermanfaat dengan masyarakat kerana peguam sebegini , sudah pasti mereka perlu jaga nama baik dan reputasi mereka kerana mereka dikenali oleh orang ramai. Jadi tak kan lah mereka sanggup menyeleweng kerana ia akan menjejaskan reputasi dan nama baik mereka.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">6. Pilihlah peguam yang aktif dan terlibat secara langsung dalam sesebuah persatuan atau pertubuhan NGO yang memperjuangkan isu-isu masyarakat.Hal ini kerana, jika mereka mampu memperjuangkan hak masyarakat sudah tentu mereka juga akan memperjuangkan hak anak guam mereka dengan baik.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">7. Pilih peguam yang komited dan anda betul-betul yakin dengan cara kerja mereka,yang mampu membela hak dan kepentingan kita.Jangan hanya memilih peguam kerana kos guaman yang ditawarkan murah. Kos guaman urusan hartanah kebanyakannya adalah sama antara satu peguam dengan peguam yang lain.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">8.Jangan memilih firma guaman dengan hanya memandang rupa. Hanya kerana peguam tersebut memiliki ramai staf yang cantik atau keadaan ofis yang cantik dipandang belum tentu hasil kerja mereka memuaskan. Istilah \u2018 Don\u2019t Judge A Book By It\u2019s Cover\u2019 sangat relevan dengan kes ini.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">9. Wujudkan keserasian dengan peguam kita, berkawanlah dengan mereka untuk memudahkan segala urusan.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">10. Doa!! Akhirnya jangan lupa berdoa kepada Allah Taala agar ditemukan dengan peguam yang baik dan beriman dalam urusan hartanah anda.Peguam tak hensem tak apa. Janji beliau beriman dan berakhlak mulia.<\/div><div dir=\"auto\">\u00a0<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Tips ini hanyalah pandangan peribadi Tuan Salkukhairi Sukor semata-mata. Sama seperti memilih pasangan hidup juga.<\/div><\/div><div class=\"o9v6fnle cxmmr5t8 oygrvhab hcukyx3x c1et5uql ii04i59q\"><div dir=\"auto\">Pendek kata anda hanya boleh berusaha untuk memilih peguam hartanah yang anda rasa terbaik untuk anda dan mematuhi kriteria di atas. Selebihnya berdoa dan bertawakal lah kepada Allah. Segala ketentuan dalam hidup kita ini Dia yang menentukannya. Majlis Peguam ada menetapkan bahawa seorang peguam hanya boleh mewakili satu pihak. Manakala, urusan jual beli dengan pemaju terutama dalam pembinaan, kebiasaannya mereka menyediakan beberapa peguam untuk pembeli pilih. Ini kerana pemaju mahukan urusan jual beli dapat dikawal dan memudahkan proses tukar hak milik berjalan dengan lancar.
